Child custody question.. rights of the father?

An unmarried couple (together 7 years) with 2 children, 3yrs and 6 months old, are breaking up. The father has been completely and totally involved every step of the way. Good dad, supportive, financially and otherwise. The couple has co-habitated for almost 6 years, What are his rights if the mother of the children is planning on taking the kids and moving out of state? They live in Jacksonville, North Carolina, and she’s making plans to move to Maryland. Nothing has been brought to the family court system yet, just curious about the best plan for the father. What are the potential possibilities?

He better move fast on this one. If those are his children he has a legal right to them and what she is doing is fleeing the state which is federal and obstructing visitation rights to the father. But he must have an order in place from the judge giving him visitation rights as well as a child support order, The order will also include a parenting plan stating what both parents rights are including relocating. Usually stating she must go before the judge before she relocates or she could be held in contempt of court meaning she disobeyed an order and can be punished by making her stay or changing custody to the father. Look up custody statue for her state.

Child support and custody rights?

I never went to court with my ex to decide custody or child support of our 2 1/2 year old. There are different problems that keep arising, and he is very rough with our son. They play with swords and he teaches him karate, both of which I think he is too young for. I now want to seek custody of my son, and get child support, but I have no clue how to go about it. What are my chances of getting custody if my ex is 20 and still living at home with no clue what he wants to do, but he does work, and I am in University, not working, but engaged to a man that is in the Air Force? And how do I go about filing for custody and child support?

the only way correct to go through this is with a lawyer; you’ll also fair better with a lawyer;; the courts don’t care about the miniscule bickering between parents about who’s parental style is ‘best”; the courts are concerned about the child’s right to have both parents present in his/her life, in spite of what ONE parent may ‘feel’; IF you are the primary caregiver of this child, chances are that this situation would not change; but your ex has every right to ask for visitation, joint custody, shared parenting;; your presentaion on lifestyle re: married or not can be beneficial & detrimental in both ways;; the fact that he is working while you are not can mean different things to different judges..so, again, ‘painting a picture’ is the least of their concerns; they truly want the parents to get along, compromise, & work together to raise this child;; if ya can’t decide between the 2 of you, they do;; another thing, custody & child support are usually dealt with together ONLY on the first court hearing to ‘balance things out’ between the 2 ex’s (the courts sorta use this as a tool to demonstrate compromising);; they are not taken care of in the same court system, they are separate altogether..good luck, not easy, but you may be better off without the courts if the 2 of you can handle it;; but honestly, ya can’t tell him how to raise his son, nor can he tell you..best you can do is compromise for your child’s future…if you 2 are not on the same page, expect your child to demonstrate the repurcussions..ya can’t force someone to do things your way…be careful & good luck!!

Fathers Rights?

My boyfriend recently had a dna test done and found out that Matthew(7 months old is his)–he has been fighting the whole 7 months for the mother to go and get the dna test done and has been buying everything for the baby and giving her money in the meantime as well. She will not let him see his child at all because he is with me and I am pregant with his child. The reason he left her is because he found out she was shooting up and using drugs while she was pregnant. She has previous felonies and drug charges and violations of her probation. She laso lost custody of her one child. My boyfriend wants to fight for full custody or atleast partial custody of his son but doesnt know what rights he has? We live in TN…the mother of the child is still doing dope and the conditions she has her 2 kids living in are terrible—trash everywhere,ashtrays next to the crib,cats and dogs everywhere—its like a dumpster in their. What would be th e best thing for my boyfriend to do about this?

Your boyfriend sounds like a caring man who is trying to do the right thing for his child, be glad he is that way, it bodes well for you and your child. Matthew needs to be removed from his mother…No doubts about that. I don’t know the laws in TN, but the father of a child has rights and the law will usually choose the father in a case of an unfit mother. Go to a lawyer and explain everything, if you can’t afford one, most states have some sort of Legal Aid. In a case like this, where the mother is obviously unfit to raise a child and the father wants it, “The Best” lawyer isn’t always necessary, the state will do what is best for the child. Your lawyer will know what procedures to follow, but make sure he knows that it is an emergency…You have to get the child out of this situation! Good Luck with Matthew and bless you for being a caring enough person to care so deeply for someone else’s child. I think Matthew and your child will have a great mother in you.
